What permits do you need to build a house in Virginia?

Short answer

A new Virginia house needs a building permit under the Uniform Statewide Building Code and the approvals before it: health department sewage and well permits without public service, a VDOT entrance permit for a new drive off a state road, erosion control approval at 10,000 square feet of disturbance or a lower local figure, and in some counties a 911 address. A certificate of occupancy comes last.

Before the application

Carroll County wants proof from every other agency first

The building permit is the permit people name, but in Carroll County it is the last approval of the first round, not the first. The county's posted cover sheet for a new dwelling spells out the order.

If any of the above Agencies will be involved or required for your project, evidence of approval or authorization from the appropriate agency is required before any Building Permits can be issued.

The agencies above that sentence on the sheet are these:

  1. Land disturbance: a project of 10,000 square feet or more is told to contact the county Inspection Department, and one acre or more also brings stormwater compliance.
  2. VDOT: an entrance permit for access from VDOT-regulated roads.
  3. The Virginia Department of Health: a construction permit, or a Safe, Adequate and Proper determination letter, for a private septic system.
  4. An E911 address from the Twin County E-911 Commission, 276-236-5122.

The same sheet says the state is under the 2021 Uniform Statewide Building Code, made effective January 18, 2024. Virginia's Board of Housing and Community Development adopts that code and it supersedes local building codes, so the rules for the house itself are the same across the state even where the checklist in front of them differs. In Carroll the application is a fillable form emailed to the Building Official, (276) 730-3016, with all required plan documents. Step one

The health department's sewage and well permits

On land without public sewer, the building permit cannot issue until the health department has acted, because Va. Code 32.1-165 holds any permit for a building designed for human occupancy behind the Health Commissioner's prior written authorization.

The permit is a state one. Under 12VAC5-610-240 and -250 a written permit from the Health Commissioner is required to construct a sewage disposal system, and every request for a construction permit goes first to the district or local health department.

The work behind the permit is a soil evaluation, with any percolation test weighed as one criterion among many; the procedure and what a perc test does and does not show are covered in how perc tests and soil evaluations work. Where the drainfield will go is part of that work, and it is one of the things a building code site plan shows when the building official asks for one.

A private well is a second permit from the Health Commissioner. Since November 6, 2024, 12VAC5-630-220 B has required a written construction permit before anyone constructs, alters, abandons or deepens a private well.

Step two

An entrance VDOT permits, and an address the dispatcher can find

Two approvals attach the lot to the outside world: where the drive meets the road, and what the house is called.

Where a new private entrance meets a state highway, 24VAC30-73-90 puts the duty on the property owner to obtain the entrance permit. The counties add their own qualifiers. Wythe County wants the entrance permit before a building permit application when a new driveway is cut off a state-maintained road, and says that does not apply to an existing driveway or a private road. Grayson lists a VDOT entrance permit for new buildings served by a new drive onto a secondary highway. The address is a separate step. Carroll's cover sheet points applicants to the Twin County E-911 Commission, and Grayson's building permit prerequisites include a 911 address for the building location, posted visible from the road. Step three

Erosion control at 10,000 square feet, stormwater at an acre

Clearing a house site, a drive and a septic area adds up, and past a threshold the ground work needs its own approval before a machine starts.

The state regulations reach land disturbance of 10,000 square feet or more, or 2,500 square feet or more inside a designated Chesapeake Bay Preservation Area, and the locality may reduce either figure. In a locality running a Virginia Erosion and Sediment Control Program, Va. Code 62.1-44.15:55 A bars regulated disturbance until an erosion and sediment control plan is approved; in a locality running the combined erosion and stormwater program, Va. Code 62.1-44.15:34 A requires the program authority's land-disturbance approval first. Both sections carry their thresholds and exemptions.

Carroll County is an erosion and sediment control program authority: it wants a plan before 10,000 square feet or more of soil is exposed, may let a single-family residence use an agreement in lieu of one, and requires a land-disturbing permit before disturbance begins. Stormwater is the second layer. Under Va. Code 62.1-44.15:34 E 1, a site disturbing an acre or more, or a smaller site inside a larger common plan that reaches an acre, may be required to obtain permit coverage, and in Carroll County DEQ administers stormwater. Step four

One application, separate trades, and inspections from the footing up

With the prerequisites in hand, the building permit application goes to the local building official, and under USBC Section 108.1 the permit has to be obtained before construction begins, unless the building official authorizes work to start sooner.

Enforcement is local. The local building department enforces the code for construction, and a town under 3,500 people may choose to enforce it; where a town does not, the county does it for the town. Separate or combined permits may be required for building, plumbing, electrical and mechanical work, so one house can carry more than one permit number.

The permit sets up the inspections, from the footing excavations before any concrete goes in through the final inspection that completes the permit.

A manufactured home follows its own path under the building code's exemption for homes built to their own state safety regulations, with exceptions; that does not mean no permit, and Carroll County posts a separate Manufactured Home Permit Application Packet. The last step

The certificate of occupancy, and each county's list side by side

The sequence ends where it has to before anyone moves in. A certificate of occupancy must be obtained before a building is occupied, and the building official issues it within five working days after the final inspection is approved and the building is found to comply.

Does a house built on a farm skip the building code?

No. Virginia's farm exemption covers a farm building or structure defined as one "not used for residential purposes", located where farming operations take place and used primarily for listed farm uses. A dwelling does not fit that definition.

Does the 911 address have to exist before a house permit issues?

In some counties it is on the list. Carroll County's new-dwelling cover sheet names a 911 address from the Twin County E-911 Commission among the agency approvals it wants evidence of before any building permit can be issued, and Grayson County's building permit prerequisites include a 911 address for the building location, posted visible from the road. Elsewhere, the local building office says which approvals it wants first.
