How do I subdivide land in Virginia?
Submit a plat to your locality's designated agent, get approval, and record it. A certified professional engineer or land surveyor prepares it, the agent has 60 days to act, or 40 for plats solely involving commercial or residential real estate, plus any state agency review, and approval is withdrawn unless the plat is filed for recordation within six months, a period the governing body may lengthen and surety can extend.
Before a line is drawn, find the office that acts on this parcel's plat
The first step happens before anyone walks a boundary: find out which office acts on a plat for this particular parcel. Every Virginia locality has to adopt a subdivision ordinance, so there is always a process, but the office behind it follows the jurisdiction line, not the mailing address.
The Code calls the reviewer the designated agent: the person a locality authorizes to review and act on subdivision plats. The local planning commission is not the designated agent, except that it may serve as one in a locality with a population of 5,000 or less. Carroll County's own page names the Subdivision Agent or the Planning Commission as the body whose approval a plat needs before it is recorded.
Town and city lines move the desk. Carroll's subdivision ordinance stops at incorporated town and city limits, and who reviews a plat inside a town is set out on the Hillsville town page. The City of Galax is separate again: its Zoning Administrator handles subdivision plats, and City Council approves major subdivision plats. In any other county, that county's subdivision agent is the one to confirm the local steps.
Whether your split is a subdivision at all depends on the definition the locality uses, and Carroll's ordinance treats any division of a lot or parcel as one. An engineer or land surveyor draws the plat and certifies the title
A plat is the schematic representation of land divided or to be divided. The one that gets recorded has to be prepared by a certified professional engineer or land surveyor, who endorses a signed certificate on it setting out the owner's source of title and the place of record of the last instrument in the chain of title. Every plat also carries a statement that the platting "is with the free consent and in accordance with the desire of the undersigned owners".
The standards the lots, streets and drainage have to meet come from the subdivision ordinance the plat answers to, because Va. Code 15.2-2241 lists subjects every such ordinance must cover, down to the monuments that mark street and property lines.

A tentative layout comes first where the ordinance asks for one
An ordinance can put a tentative layout ahead of the final plat. State law lets a locality make that step mandatory for plats involving more than 50 lots, provided a landowner with 50 or fewer can still submit one by choice. Carroll's posted ordinance has the subdivider apply in writing for preliminary plat approval whenever a subdivision is proposed. In Carroll, once the preliminary plat returns from the agencies the ordinance names, the Administrator reviews it and responds to the subdivider in writing within 60 days, a period the two can extend by agreement.
The designated agent reviews against clocks the Code sets
The owner who wants to subdivide submits the plat of the proposed subdivision to the designated agent. From there Va. Code 15.2-2259 runs the review on a schedule:
- 60 days for the agent to approve or disapprove a proposed plat after it is officially submitted, in writing, with specific reasons for a disapproval.
- 45 days on that same track to act on a plat it previously disapproved, counted from resubmission.
- 40 days instead for plats solely involving commercial or residential real estate, as that section defines those two terms.
- Five business days to forward the plat to a state agency when a feature needs that agency's approval, which extends the agent's time; the agency, VDOT for example, completes its first review within 30 days of receiving the plat, unless a different statutory period applies to that plat.
- 20 days for the agent to act once every agency approval is in.
A new road is one feature that can send a plat to a state agency, and the standards a new street has to meet are covered in whether subdivision roads have to meet VDOT standards. Carroll's added steps, from a four-lot split to the Planning Commission
Because Carroll counts a split that creates even one new lot as a subdivision, every division runs the county's sequence. The posted ordinance then sorts the path by the number of new lots and whether a new road is involved.
Small subdivision
A proposed subdivision creating four or fewer new lots, all on and served by an existing state maintained road, may be reviewed and approved by the Agent without referral to the Administrator.
The Highway Department referral
The Agent may approve that small plat without referral to the Highway Department only when no new roads are created and the PSA or the Health Department, as applicable, has approved it. Every other provision of the ordinance still applies to its contents.
Final plats before the Administrator
The Administrator approves no final plat until the Highway Department, the PSA and the Health Department of Carroll County have approved it.
Plats for the Planning Commission
The county's web page asks for plats 14 days before the meeting, while the posted ordinance says at least 14 business days, which runs closer to three calendar weeks. Confirm the deadline with Land Use and Planning before counting back from a meeting date.

Approval is not the finish: the plat has to reach the clerk in time
Where a subdivision ordinance applies, no one may subdivide land without making and recording a plat and fully complying with the ordinance, and no plat is recorded until the designated agent approves it. The clerk is bound the same way: no clerk of court may file or record a plat that has to be approved until it has been. The approved, recordable version is the final plat.
Recording has its own deadline under Va. Code 15.2-2241: unless the plat is filed for recordation "within six months after final approval thereof or such longer period as may be approved by the governing body", the approval is withdrawn and the plat marked void. Surety for facilities to be dedicated for public use can extend that clock, as the final plat entry explains.
In Carroll, recording also opens the next door: no permit issues for erecting or occupying a structure in the subdivision until its plat is approved and recorded. When does the plat review clock start running?
Va. Code 15.2-2259 runs both the 60-day clock and the 40-day clock for plats solely involving commercial or residential real estate from the date a proposed plat is officially submitted for approval. On the 60-day track, a plat the agent previously disapproved gets 45 days from resubmission. What a locality treats as an official, complete submission comes from its own process, so the subdivision agent for the parcel is the one to ask what the package has to include.
Does a health department signature on the plat mean each lot will get a septic permit?
No. The Virginia Department of Health regulation says a department employee's signature on a recorded plat does not imply that any lot identified as approved will be issued a sewage disposal construction permit, unless all conditions and circumstances in the original approval, such as landscaping, still exist when the permit is applied for. The permit is a separate application.
Does the designated agent have to explain why a plat was disapproved?
Yes. Va. Code 15.2-2259 has the agent approve or disapprove a proposed plat in writing and give specific reasons with a disapproval. On the 60-day track the agent then has 45 days to act on the plat once it is resubmitted, and the subdivider may instead appeal to the circuit court within 60 days of the written disapproval. Which of those to pursue is a question for an attorney.
