Does Carroll County have zoning?

Short answer

No. Carroll County has no county zoning ordinance; its 2024 comprehensive plan says the county does not utilize zoning, and the Planning Commission tabled a draft zoning ordinance until further notice. Land outside the Town of Hillsville still answers to the county's Subdivision of Land ordinance, which treats any division as a subdivision, and to its Manufactured Home Park Ordinance. Inside Hillsville, the Town's own zoning applies.

Carroll's own 2024 plan answers the question in one sentence

At present, Carroll County does not utilize zoning, and it is important to understand that the Comprehensive Plan is not another name for zoning.

That sentence does two jobs. It confirms there are no county zoning districts, and it heads off a misreading: that the comprehensive plan, with its maps and its goals for the county, works as zoning by another name. It does not. A plan sets out the county's intentions for its land; it is not an ordinance a permit desk enforces.

The county repeats the point elsewhere. Its economic development page lists no zoning among what Carroll offers a business, alongside its workforce and its permitting and inspection process.

The tabled draft

A draft zoning ordinance exists, and the Planning Commission set it aside

Anyone who searches the county's website will find the words Carroll County Draft Zoning Ordinance, and it is fair to wonder whether zoning is on its way. The Planning Commission's own page records where that draft stands.

A motion was passed for the Planning Commission to table further discussions of the proposed zoning ordinance and associated maps until further notice.

A tabled draft is not law. Nothing in it applies to a parcel today, and this page will not guess whether or when it comes back. What still applies

The ordinance Virginia requires of every county reaches every Carroll split

Zoning is optional in Virginia. A subdivision ordinance is not. Va. Code 15.2-2240 requires the governing body of every locality to adopt one, and in Carroll County it is the county rule that reaches a parcel the moment an owner divides it.

The county's Land Use and Planning page puts the scope as broadly as it can be put: any division of a lot or parcel of land is a subdivision, the subdivider must comply with the Subdivision of Land ordinance, and every subdivision needs a plat approved by the Subdivision Agent or the Planning Commission before it is recorded in the Circuit Court Clerk's Office. That reaches further than the Code's default definition of a subdivision, which applies only where a local ordinance has not defined the term; in Carroll a single split is itself a subdivision. The ordinance also sorts divisions into kinds. It classifies subdivisions as Class A, Class B or Family subdivisions, and its definitions describe a Class C as well, each with its own road and lot rules. And it does some of the work a buyer might expect zoning to do: in a Carroll County subdivision, no building may stand closer than 35 feet to the adjacent edge of any street or 15 feet to the boundary of the lot.

A second county ordinance

Manufactured homes answer to a park ordinance, with an exception for family placements

The other county land rule a Carroll owner is likely to meet has nothing to do with dividing ground. It is the Manufactured Home Park Ordinance, and its definition and its exception have to be read together.

The county's Land Use and Planning page and the ordinance both count a tract designed, constructed and equipped for two or more manufactured homes as a park, and the page says any park's developer must comply with the ordinance. The posted ordinance then exempts an owner who places homes on his own property for members of his immediate family, and applies its Article 15 to those placements.

Where the answer flips

Inside the Hillsville town limits, county rules stop and town zoning starts

Everything above is about unincorporated Carroll County. The county's subdivision ordinance applies to land in Carroll County that is not within the jurisdiction of incorporated municipalities, and the Town of Hillsville is incorporated.

State permitting does not stop at the town line: under the Virginia Department of Health's regulations, all buildings and residences designed for human occupancy must be served by an approved sewerage system. Does no zoning mean I can put any use I want on land in Carroll County?

No zoning removes the county district and its use list, not every rule. Outside Hillsville, any division still needs an approved, recorded plat under the Subdivision of Land ordinance, manufactured home placements fall under the Manufactured Home Park Ordinance, and state permits such as sewage approval still apply. Whether a specific use needs a specific permit is a question for Carroll County Land Use and Planning and the building official.

Does the 35-foot street setback apply to land in Carroll County that has never been subdivided?

Carroll's posted subdivision ordinance states the 35-foot and 15-foot distances for buildings in a subdivision.
